In BC, most people must be separated for at least one year before a court will grant a divorce. While you can start the legal process and resolve property or parenting issues immediately after separating, the final divorce order usually requires the one year waiting period. Exceptions exist for cases involving adultery or cruelty.

Even in amicable separations, a lawyer is necessary to ensure your agreement is legally binding and enforceable. If an agreement is not drafted correctly, it may be set aside by a court later.
